Denbighshire County Council are investigating multiple alleged breaches of planning control on a farm in the County.

The Council are investigating the site in Llanarmon-yn-Iâl following concerns that a range of modifications have been made without the appropriate planning permission.

The site owners have allegedly made material changes to the use of agricultural land through permanent residential occupation, created a private way and hardstanding as well as erected shelters. They have also allegedly changed the use of land through the establishment of holiday lets, incorporating the erection of cabins with raised platforms, all without the appropriate planning permission.

Enforcement notices were issued for each infringement requiring the landowner to either cease or apply for planning permission, however all compliance periods have since expired with no response.

In continuing their investigation, the Council’s officers attempted to access the site in Llanarmon-yn-Iâl under a warrant from Llandudno Magistrates Court, but they were refused entry.

Due to the non-compliance, the landowner was prosecuted and found guilty of wilfully obstructing a person acting in the exercise of a right of entry. They were ordered to pay a fine as well as Denbighshire County Council’s full legal costs.

Councillor Alan James, Lead Member for Local Development and Planning said:

“We want to remind everyone in the County the importance of obtaining the appropriate planning permission when required to do so. Failure to do so may result in further legal action by the Council.

“This reinforces the message that this Council will pursue landowners who undertake harmful development and who may choose to obstruct Officers in the carrying out their lawful regulatory work”.
