Gamlins Law secures £1.75million settlement for teenage brain injury claimant

A North Wales law firm has settled a claim on behalf of a teenage brain injury client for £1.75million.

The claimant was seven years old when he was a rear passenger in a car driven by his aunt that was struck head on at a speed of approximately 100mph.

As a result of the road traffic accident, the claimant, now 18, sustained facial injuries, including orbital fractures and a nasal fracture, permanent facial scarring, a seatbelt injury to the chest wall and shoulder and, most significantly, a moderate-severe traumatic brain injury.

Gamlins Law lawyers Simon Roberts and Elen Wynne Roberts secured a comprehensive rehabilitation package and interim payments from the defendant’s insurance company to assist their client as he progressed through childhood to adulthood.

The settlement will also provide him with the assistance he will require for his ongoing needs.

Elen said: “It is one of the longest cases we have dealt with lasting over 11 years.

“Our client has been fortunate to have an extremely supportive family. At the time of the accident, he was in good health and doing well at school.

“His mother has spent a large amount of time assisting him with his studies and helping him to obtain and manage his part-time jobs.

“He will continue to require the lifelong involvement of a support worker and assistance with domestic tasks.”

At the conclusion of the case, the claimant’s mother said: “I couldn’t have asked more of Simon and Elen. They have been compassionate, diligent, with a real attention to detail. Highly professional, responsive, clear on timeframes and always approachable. They worked on a very complex case that took years of work, leading to an excellent outcome. I recommend them unreservedly.”

The settlement is the latest success for the personal injury and clinical negligence team at Gamlins Law.

During the last year, they have recovered over £4million in damages along with more than £500,000 for clients in interim payments. They have also been successful in securing many care and rehabilitation packages and having homes adapted for clients across the UK.

Simon said: “We are currently handling a wide-ranging caseload including accidents at work, road traffic accidents, agricultural accidents and clinical negligence actions which involve injuries of the utmost severity including brain injuries, amputations, birth injuries and cancer misdiagnoses.

“While many of the claims are from the North and Mid Wales area, we also regularly receive instructions from clients across the UK due to the experience and expertise of our specialist lawyers.”
